These Terms of Service ("Terms") govern your access to and use of the SwapX platform, website and related services (the "Service"). The Service is operated by ETNERA LTD, a private limited company incorporated under the laws of Cyprus, with its registered office at: Neofytou Nikolaidi & Theodorou Kolokotroni, Onisiforou Center, 2nd Floor, Agios Theodoros, 8011 Paphos, Cyprus. Company registration number: HE480731 ("SwapX", "we", "us", "our"). By accessing or using the Service, you confirm that you have read, understood and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
For the purposes of these Terms:
3.1. SwapX operates as a principal. When you sell Items through the Service, you enter into a direct Transaction with SwapX.
3.2. SwapX is not a marketplace, broker, agent, escrow provider, payment institution or electronic money institution.

3.4. All Item transfers are executed exclusively through Steam. SwapX is not affiliated with Valve Corporation or Steam.
4.1. You must be at least 18 years old and have full legal capacity to enter into binding agreements.
4.2. You may only use the Service if such use is lawful in your jurisdiction.
4.3. You are solely responsible for compliance with all applicable laws, including any tax obligations arising from Transactions.
5.1. Access to the Service requires authentication via your Steam account.

By using the Service, you represent and warrant that:
a) you are the lawful owner of the Items;
b) the Items are not stolen, encumbered or subject to third-party claims;
c) the Items were not obtained through fraud, abuse or violation of Steam's terms;
d) you act on your own behalf and not for a third party.
7.1 Transaction Formation
A Transaction is initiated when you accept a trade offer on Steam transferring Items to SwapX.
7.2 Conditional Transfer and Trade Protection
7.2.1. The transfer of Items is conditional and subject to Steam's Trade Protection mechanism.
7.2.2. During the Trade Protection Period:
7.2.3. Until expiration of the Trade Protection Period without reversal, the Transaction is considered pending.
8.1. SwapX's obligation to execute a payout arises only after:

8.3. SwapX does not hold User funds at any time. A payout constitutes a new payment obligation arising only after Transaction finalization.
9.1. If the User initiates a reversal during the Trade Protection Period:
9.2. If a reversal occurs after payout due to exceptional circumstances, SwapX reserves the right to:
10.1. Prices are determined by SwapX at its sole discretion.
10.2. SwapX earns remuneration through pricing spreads or service fees included in the offered price.
10.3. Prices may change at any time prior to acceptance of a Transaction.
11.1. SwapX applies a risk-based and proportional KYC approach.
11.2. Identity verification may be required prior to payout, including verification of ownership of the payment method.
11.3. Failure to complete required verification may result in payout refusal or delay.
12.1. The Service is not available to persons subject to EU, UN, OFAC or UK sanctions or located in high-risk jurisdictions.
12.2. Use of VPNs, proxies or identity-obfuscating technologies is prohibited.

The User acknowledges that SwapX's system records, logs, timestamps, transaction IDs, Steam trade confirmations and internal monitoring data constitute prima facie evidence of Transactions, their timing and status, unless proven otherwise.
15.1. By initiating a Transaction, you expressly request immediate digital performance and acknowledge that the statutory right of withdrawal does not apply once execution begins, where permitted by applicable law.
15.2. Nothing in these Terms limits mandatory consumer rights under applicable law.
SwapX may suspend or terminate access to the Service if:
The Service is provided "as is" and "as available". SwapX does not guarantee uninterrupted availability or error-free operation.
18.1. To the maximum extent permitted by law, SwapX shall not be liable for indirect, consequential or special damages, including loss of profit or opportunity.
18.2. SwapX's total liability shall not exceed the amount paid to the User in the Transaction giving rise to the claim.
You agree to indemnify and hold SwapX harmless from any claims, damages or liabilities arising from your breach of these Terms, misrepresentations or unlawful use of the Service.
The Service depends on Steam and its technical and policy framework. SwapX is not responsible for actions, decisions or reversals initiated through Steam.
These Terms are governed by the laws of Cyprus, without prejudice to mandatory consumer protections under EU law.
These Terms constitute the entire agreement between you and SwapX regarding the Service and supersede any prior representations.
In case of discrepancies, the English version shall prevail.
SwapX may amend these Terms at any time. Continued use of the Service constitutes acceptance of the amended Terms.
